Absolutely ok to cap those two bottom ones and add the pigtail to the switch. No issues. Plus you have extra wire now.

If those are two hots bundled together (I don’t know if they are or not) and you are asking if you can pigtail onto them to connect to the Line of an Innovelli, you would be better just separating the two blacks that are currently bundled and using both backstab holes on the Innovelli. That way you still keep the two blacks connected and the switch is powered.
The added bonus of that is that there are less wires in the box. The less wires, the easier it is to get the switches in. Additionally, boxes have capacities calculated by wires and devices. I’m not saying you would be over capacity, but why add a pigtail when you don’t have to!
